On September 5, 2014, a jury issued a verdict in favor of the plaintiffs, Jo and Allen Huskey, for damages suffered by Jo as a result of a mesh implant manufactured by Ethicon, Inc.
The case was tried by Jeffrey Kuntz of Wagstaff & Cartmell (Kansas City), Ed Wallace of Wexler Wallace (Chicago), and Fidelma Fitzpatrick of Motely Rice (Providence, RI).
Mr. Kuntz, along with Tom Cartmell of Wagstaff & Cartmell, act as co-counsel for our firm on every transvaginal mesh case we file.
In April of this year, a jury awarded another plaintiff, Linda Batiste, $1.2 million, in a case involving the same device. Mr. Cartmell was part of the trial team in that case.
“These verdicts make for big headlines, but most importantly they represent justice for real people who were harmed by untested products,” said attorney Mason Boling of Keith, Miller, Butler, Schneider & Pawlik, PLLC. “Juries made up of ordinary people – not lawyers or judges or scientific experts – hear the facts of these cases and come to a simple conclusion: the doctors didn’t do anything wrong, and the patients didn’t do anything wrong. The mesh manufacturers knew they were selling a dangerous product and did everything they could to hide that fact.”
